Anna Nicole Smith boyfriend convicted in drug trial (Reuters)

LOS ANGELES (Reuters) – Anna Nicole Smith's former boyfriend and a doctor were convicted on Thursday of helping to keep the former Playboy model supplied with painkillers and other prescription drugs before her death.

But after a two month trial, a Los Angeles jury acquitted a second doctor on all charges in what was seen by the defense as a victory for physicians who treat patients with chronic pain.

Smith's companion and lawyer Howard K. Stern was convicted on two counts of conspiracy for using false names to obtain prescription drugs for his lover, but was acquitted on seven more serious charges.

Smith's psychiatrist Khristine Eroshevich was convicted on four counts. A January 6 date was set for sentencing, and a spokeswoman for the Los Angeles District Attorney said the pair could get anything from probation to three years in prison.

The three were not charged in the 2007 death of Smith, known as a model, TV star and for marrying an 89-year-old oil billionaire, 63 years older than her, in the 1990s. She died at age 39 from an accidental prescription drug overdose.

Stern, Eroshevich and physician Sandeep Kapoor had all pleaded not guilty to multiple charges of fraudulently providing drugs and controlled substances to a known addict.

Their lawyers argued that Smith needed the drugs for legitimate purposes, including the caesarean birth of her daughter Danielynn in 2006 and the death of her adult son days after. She used fake names to protect her privacy, they said.

The jury reached its split verdict after 13 days of deliberations following a trial that saw the judge criticize prosecutors for being overly aggressive and throw out some of the original charges against the trio.

Prosecutors said the three conspired to provide the late fashion model and reality TV star with a cocktail of painkillers, muscle relaxants, anti-depressants and anti-anxiety drugs by writing or seeking prescriptions using several false names.

The defense said their clients cared for Smith and would not harm her, and argued she used the drugs to help her sleep and control severe pain.

"This is the right result, not just for Kapoor, but for patients everywhere," Kapoor's lawyer Ellyn Garofalo told journalists.

"This was a misplaced and ill-conceived prosecution," Garofalo added, saying law enforcement officials should focus their resources on illicit drug pushers who supply pills for nonmedical purposes.

Eroshevich told reporters that she had few regrets about helping Smith.

"She (Anna Nicole) had a lot of problems. She was a good person and a friend," the psychiatrist said.

The investigation was backed by California Attorney General Jerry Brown, running for governor in elections next week.

Brown has mounted a tough campaign against prescription drug abuse, and officials in his office helped investigate the 2009 death of Michael Jackson. The singer's personal doctor has been charged with the involuntary manslaughter of Jackson.

LOS ANGELES – A jury has absolved Anna Nicole Smith's doctor of prescribing excessive drugs for her but convicted her boyfriend and a psychiatrist of conspiring to use fake names on prescriptions, in a case that refocused attention on the deceased model's made-for-tabloids story.

The nine-week trial of the three who were part of the late Playboy model's inner circle brought the aura of glamor surrounding her to the courtroom through photos and videos of the beautiful blond who starred in her own reality TV show. In death, she managed to be the star of the high-profile trial.

Howard K. Stern, who was described as Smith's manager, lawyer, lover and best friend, was acquitted Thursday of seven of the 11 charges originally lodged against him. Superior Court Judge Robert Perry had already dismissed two charges against Stern. The jury found him guilty of two conspiracy counts and specified they were for obtaining a controlled substance by fraud and giving a false name for a prescription.

Dr. Khristine Eroshevich was convicted of conspiring with Stern on the fraud and false name allegations and was convicted on two separate counts of unlawfully prescribing and obtaining Vicodin through fraud and use of a false name.

Dr. Sandeep Kapoor, 42, who prescribed an array of sedatives and opiates to Smith, was acquitted of prescribing excessive drugs and prescribing to an addict. He hailed his acquittal as a triumph for the medical field of pain management.

"This is not just a victory for me, but for patients everywhere who suffer chronic pain," an emotional Kapoor said outside court.

His lawyer Ellyn Garofalo said it also was a victory for Smith.

"The jury found she was not an addict," Garofalo said.

The 39-year-old Smith died of an accidental drug overdose in Florida in 2007, but the defendants were not charged in her death.

The six women and six men of the jury who sat through weeks of testimony and deliberated for 58 hours over 13 days left quickly and eluded reporters.

Prosecutors Renee Rose and David Barkhurst also declined comment saying the case was not yet concluded. A hearing was set for Jan. 6 for new trial motions and, if those are denied, sentencing. It was unclear how much prison time Stern and Eroshevich could face.

Los Angeles County District Attorney Steve Cooley said in a written statement he was pleased there were some guilty verdicts.

The prosecutors contended the defendants were dazzled by Smith's glamor and filled her demands for prescription drugs to protect their insider status in her personal life and her celebrity world. Jurors appeared to reject that argument.

The panel deadlocked on a number of prescribing allegations against Eroshevich and Stern.

Defense attorneys portrayed the defendants as angels of mercy who were trying to help Smith cope with her chronic pain, particularly after she gave birth to her daughter by cesarean then quickly lost her 20-year-old son, Daniel, to a drug overdose.

As he left the courthouse, Stern, 41, told reporters: "Everything relating to the appropriateness of the medication, I was acquitted of."

His lawyer, Steve Sadow, said Stern never denied using his name on Smith's prescriptions but maintained Stern didn't know it was illegal.

"And under the circumstances, the judge has the power to sentence Howard as a misdemeanor offender and not a felon," Sadow said Friday on CBS's "The Early Show." "We are hopeful and expecting that the judge will be willing to do that under all these circumstances and that Howard will not go to jail for any reason."

Eroshevich, 63, was Smith's neighbor and friend before treating her as a psychiatrist. Prosecutors claimed the friendship was a violation of professional ethics and called as a witness a pharmacist who testified the amount of drugs Eroshevich requested for Smith at one point would have amounted to pharmaceutical suicide.

The pharmacist refused to fill the request, and prosecutors showed Eroshevich used other pharmacies to get most of the drugs, some under fictitious names, and took them to Smith in the Bahamas.

"I feel relieved," Eroshevich said outside court. "I'm just happy it's over."

Stern and Eroshevich remained free pending the next hearing, Both could face loss of their professional licenses to practice.

LOS ANGELES (AFP) – The boyfriend of Anna Nicole Smith, Howard K. Stern, was found guilty of two conspiracy counts relating to using a false name to secure prescription drugs for the late Playboy model.

Stern, 41, who was Smith's longtime lawyer and boyfriend, was acquitted on seven counts of obtaining and providing drugs to an addict but convicted of two conspiracy counts of aiding and abetting.

Smith died at a Florida hotel room in February 2007 after an overdose. She was 39.

"What the jury did find me guilty of were two conspiracy counts limited exclusively to my name being used on medication for Anna," Stern said after the verdict.

"Now, this was done to protect Anna Nicole's privacy and it was nothing more than that."

Psychiatrist Khristine Eroshevich, 62, was convicted of four counts of fraudulently obtaining medication when prescribing drugs to the starlet under false names.

Stern and Eroshevich could face up to three years in prison, according to prosecutors.

Another physician in the case, 42-year-old Sandeep Kapoor, was cleared of all charges. None of the defendants were charged with causing the ex-model's death.

"I think the jury did their best. I'm just happy this is over," said Eroshevich.

Her lawyer, Bradley Brunon, said "everything Kris did was done with Anna's best interests at heart."

The verdict came after a months-long trial and 13 days of deliberations. Sentencing is scheduled for January 6.

During the trial, prosecutors said the trio gave the immensely famous Smith the powerful opiates and sedatives she craved despite the lack of a legitimate medical need.

A 2007 autopsy found that Smith's death -- a worldwide media sensation at the time -- was due to a lethal cocktail of anti-anxiety medication, methadone, antibiotics and other prescription drugs.

It came just months after her son, 20-year-old Daniel, died from an overdose in the Bahamas in September 2006.

Born Vickie Lynn Marshall, Smith got married in 1994 to Texas billionaire oil tycoon Howard Marshall, who she had met earlier while working at a strip club. She was 26 at the time and he was 89.

Marshall died in 1995 after a 14-month marriage. But his adult son E. Pierce Marshall contested Smith's claim to the billionaire's inheritance in a case that reached the US Supreme Court.

The larger-than-life platinum blonde was regarded as one of the world's most desirable women in the 1990s when she replaced supermodel Claudia Schiffer as Guess Jeans model. She was also Playboy magazine's Playmate of the Year in 1993.

However, Smith fell out of the spotlight over the next decade, often appearing to be under the influence of drugs or alcohol in public.

Her daughter, Danielynn, is being raised by the child's father, Larry Birkhead.
